Terms of Service

By accessing or using ArtaFishal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

ArtaFishal provides:

• Weather forecasts and marine condition ratings
• AI-powered fishing advice and sonar analysis
• Personal fishing spot database
• Trip planning and tracking tools
• Fish behaviour intelligence

Age Requirement: You must be at least 18 years of age to create an account and use ArtaFishal. By creating an account, you represent and warrant that you are at least 18 years old. If we become aware that a user is under 18, we will terminate their account.

You agree to:

• Provide accurate account information
• Keep your password secure
• Not share your account with others
• Use the Service only for lawful fishing activities
• Not upload copyrighted charts or images you don't own
• Not attempt to reverse engineer or exploit the Service
• Comply with all local fishing regulations and maritime laws

Free Tier: Limited features available at no cost.

Pro Tier ($20 AUD/month): Unlimited Skipper conversations, sonar analysis, trip planning, and all premium features. Annual billing available.

Founding Member Tier ($149 AUD one-time): Limited to the first 50 users. Provides 3 years of full Pro access from the date of purchase. After the 3-year period expires, Founding Members may continue at a reduced rate of $10 AUD/month. Founding Member status and badge are permanent. This tier is non-transferable.

Billing: Pro subscriptions renew automatically. You can cancel anytime.

Pro Tier: You may cancel your Pro subscription at any time. No refunds are provided for partial billing periods. Your access continues until the end of the current billing period.

Founding Member Tier: You may request a full refund within 30 days of purchase by emailing help.artafishal@gmail.com. After 30 days, the payment is non-refundable. In the event ArtaFishal permanently ceases operations within the 3-year founding period, Founding Members will receive a pro-rata refund for the remaining unused time.

Your Content: You retain ownership of fishing data, notes, and spot descriptions you create. You grant us licence to store and process this data to provide the Service.

Our Content: ArtaFishal's software, AI models, design, and branding are our property. You may not copy, modify, or redistribute them.

AI-Generated Content: Skipper's fishing advice and sonar analysis are generated by AI and provided as-is. We don't claim ownership but you may not redistribute or sell this content.

You may NOT:

• Use the Service for commercial fishing operations without Enterprise licence
• Scrape, harvest, or automate data collection
• Upload malicious code or attempt to hack the Service
• Harass other users or staff
• Violate fishing regulations or maritime laws
• Resell or redistribute ArtaFishal's services

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or for any reason at our discretion. You may delete your account anytime from account settings.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE:

• Accuracy of weather forecasts or fishing advice
• Successful fishing trips or catches
• Uninterrupted access to the Service
• Error-free operation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTAFISHAL SHALL NOT BE LIABLE FOR:

• Injuries, accidents, or death while fishing or boating
• Lost fishing gear or equipment
• Unsuccessful fishing trips
• Incorrect weather forecasts or sonar analysis
• Lost data or account access issues
• Indirect, incidental, or consequential damages

MAXIMUM LIABILITY: In no event shall our total liability exceed the amount you paid us in the past 12 months.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

If the Australian Consumer Law applies to you as a consumer, our liability for failure to comply with a consumer guarantee is limited to (at our election): (a) re-supply of the services; or (b) payment of the cost of having the services supplied again.

You agree to indemnify, defend, and hold harmless ArtaFishal, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you upload, submit, or share through the Service.

ArtaFishal relies on third-party services including Stripe (payments), Clerk (authentication), Anthropic (AI), and WillyWeather (weather data). We are not responsible for outages, errors, or policy changes by these providers.

We are not liable for service interruptions caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, government actions, or third-party service failures.

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in Queensland courts.

Dispute Resolution: Before initiating any legal proceedings, you agree to first contact us at help.artafishal@gmail.com and attempt to resolve the dispute informally for at least 30 days. Any claims arising from these Terms must be brought within 12 months of the event giving rise to the claim.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes.
